GENERAL CONDITIONS OF BUSINESS (AGB) of Suelo Trade GmbH

 

  1. General information

 

All services provided by Suelo Trade GmbH to the customer are exclusively based on the following general terms and conditions. Deviating regulations shall only apply if they have been agreed in writing between Suelo Trade GmbH and the customer.

  1. Conclusion of contract

 

Only persons who have reached the age of 18 and are not limited in their business capacity at the time of conclusion of the contract are entitled to conclude the contract with Suelo Trade GmbH. We sell only in commercial quantities.

 

The order of a customer represents an offer to Suelo Trade GmbH to the conclusion of the purchase. By the order the customer gives a binding offer on conclusion of a purchase contract.

 

The order confirmation, which is automatically sent to the customer immediately after the order, as well as the acceptance of a telephone order, do not constitute a legal acceptance of ours. The automatic e-mail notification is only valid as confirmation of receipt.

 

Suelo Trade GmbH is entitled to accept this offer within 7 calendar days by sending an order confirmation or confirmation of delivery. If the 7-day deadline expires unanswered, the offer is deemed to be rejected. Suelo Trade GmbH is free to decide whether an order is accepted.

 

A purchase contract is only concluded when Suelo Trade GmbH sends the ordered product to the customer and confirms the dispatch with a second e-mail (confirmation of shipment). There is no purchase contract for products from the same order that are not listed in the shipping confirmation.

 

If a product is no longer available, we will inform the customer immediately. In this case no contract will be concluded.

 

  1. Right of withdrawal / return

 

The customer is entitled to revoke the order within 7 calendar days in text form and mandatory in German (eg letter, e-mail, fax) or by returning the goods. The period starts from the receipt of the goods by the customer. Excluded are articles which can not be withdrawn for hygienic reasons. (Hairbrush, contact gel, hair products, cosmetics, hygienic articles etc.

Suelo Trade GmbH accepts the revocation only if the articles are unused, complete (it must be all papers such as guarantee card, labels available) and in perfect original packaging. Excepted from the return are articles, which were made on order of the customer, personalized or specially ordered.

 

Suelo Trade GmbH does not refund any money for returned items.

 

If the customer is not able to recover the goods in full or in part or only in a deteriorated condition, the customer must submit to Suelo Trade GmbH. The customer is responsible to refrain from anything that affects the value of the consignment.

Parcel-ready goods must be returned. The customer bears the cost of the return and any other charges such as Customs costs, if the delivered goods corresponds to the ordered. Otherwise, the return for the customer is free of charge. Only returns are accepted, which are sufficiently franked.

 

  1.  Shipping

 

All items will be delivered immediately, if available from stock and only as long as stock lasts, assuming a successful identity and creditworthiness test.

 

The delivery takes place both within Switzerland as well as in EU countries as well as abroad.

 

The delivery time within Switzerland is a maximum of 7 working days, unless stated otherwise in the offer. (Standard are 1 - 2 business days)

 

In the case of deliveries abroad, the delivery time is a maximum of 14 business days, unless stated otherwise in the offer. (DE or AT it is approx. 4 - 6 business days) For foreign deliveries, the delivery time depends on the location of the customer.

 

The following items have a longer delivery time:

The delivery time starts with the dispatch of the order confirmation. The indication of the delivery time is non-binding, unless there is a different written agreement. If an article is not available at short notice, we inform the customer as soon as possible by e-mail about the anticipated delivery time, as long as we have an address. We reserve the right to make partial deliveries insofar as this is an efficient handling of the total delivery. No additional shipping costs will be charged for subsequent delivery. In delivery delays, e.g. By force majeure, traffic disturbances and disposals of high hand as well as other events not foreseen by Suelo Trade GmbH, no claim for damages can be asserted against Suelo Trade GmbH.

 

If the delivery is delayed by the fault of the supplier and is not (impossibly), Suelo Trade GmbH is not responsible for this.

  1. Packaging and dispatch of goods

 

We offer the following shipping methods: Swiss Post, DHL, Forwarding and others.

 

For delivery, insured and inscribed, within Switzerland and packaging costs, we charge CHF 8.30 the shipping price determined in the offer. The shipping costs will be communicated to each order.

For foreign deliveries (Germany, Austria, France + EU) we charge between CHF 13.00 and CFH 35.00

 

For orders with an order value over CHF 400.00 we deliver free of charge within Switzerland. This excludes services. For foreign deliveries the shipping costs are exempt from CHF 500.00

 

At the request of the customer also deliveries (DHL EXPRESS) can be carried out. The resulting additional costs of CHF 11.00 shall be borne by the customer.

 

The packages are all insured. The customer must notify the supplier of any transport damage immediately.

 

  1.  Prices

 

All prices are final prices and are given in Swiss francs including the legal VAT, without any packaging and shipping costs. The stated price at the time the offer was submitted by Suelo Trade GmbH is decisive for invoicing. Suelo Trade GmbH reserves the right to make mistakes and alterations.

 

Customs and VAT for goods shipped to the EU / foreign country, the buyer has to take care of himself. The goods will be delivered in this case free of VAT and the prices are without customs duties and sales tax.

When paying in advance, the customer of Suelo Trade GmbH receives an e-mail with the exact invoice data. The customer's e-mail address must be recorded in the order form so that Suelo Trade GmbH can contact the customers.   1. Proprietary retention of goods

  1. Warranty for defects in goods

 

The customer's claims against Suelo Trade GmbH arising from a defect in the goods shall be governed by the law. The customer undertakes to inspect the goods upon receipt for possible defects and to notify Suelo Trade GmbH as soon as they are found. If, at a later date, the customer determines that the goods are defective, he is obliged to inform Suelo Trade GmbH immediately after discovery. If the customer fails to notify a defect, the goods shall be deemed approved.

 

A defect in the goods does not include damages caused by the customer through improper or non-contractual treatment. Decisive for improperness and lack of conformity are the details of the manufacturer of the goods.

 

The warranty period is 24 months and which is 12 months if no different deadline on the delivered goods is indicated. It starts with the receipt of the goods to run. The shipping costs back to the customer within Switzerland is covered by Suelo Trade GmbH. Foreign customers must pay the shipping costs themselves. Only after receipt of the full amount the article will be sent!

 

If the supplementary performance has been carried out by way of replacement delivery, the customer is obliged to return the goods delivered first to Suelo Trade GmbH within 10 days. The defective goods must be returned in accordance with the legal regulations. Suelo Trade GmbH reserves the right to claim compensation under the statutory requirements.

 

In all cases, the guarantee expires in the case of interventions, repairs or attempts to repair the goods by the purchaser or an unauthorized third party without the written consent of Suelo Trade GmbH.

 

Should transport damage be found on the goods, the customer must immediately make a damage report against the freight carrier (shipping service). Other recognizable transport damages are to be submitted to Suelo Trade GmbH in writing within 2 days after receipt of the goods. However, the non-compliance of this complaint has no consequences for your legal claims.

Claims for damages against Suelo Trade GmbH are excluded, unless they are based on our intentional or grossly negligent behavior or our vicarious agents. The period of limitation for the assertion of damages shall be three years and shall commence on the date on which the act giving rise to damages was committed. Should the statutory periods of limitation in individual cases lead to a shorter statute of limitations in individual cases, these shall apply. Liability for guarantees is not subject to any liability.

 

Suelo Trade GmbH is only liable for slight negligence in accordance with the provisions of the Product Liability Act, because of injury to life, body or health or the violation of essential contractual obligations. However, the claim for damages for the slightly negligent violation of essential contractual obligations is limited to the type of foreseeable damage foreseeable, insofar as it is not due to injury to life, body or health. Should any provision of these General Terms and Conditions be void, for whatever reason, the validity of the remaining provisions shall remain unaffected. The invalid regulation is replaced immediately by the relevant legal regulation. Verbal agreements require written confirmation in order to be effective.

 

Suelo Trade GmbH expressly reserves the right to adapt these Terms and Conditions at any time to the circumstances and to apply them immediately.
